About Your Loan: When a lender makes a home loan or any property loan, it usually sells the loan to another lender. In fact your loan may have been sold several times. Most often, the company to which you make payments does not own the loan. It is merely collecting payments for the lender who owns your loan. Thus we will refer to the company to which you have been making payments as the LOAN SERVICER.

Instructions about completing this form:The form below is lengthy and may take some time to fill out. Please be thorough. We need as much detail as you can give us so that we go to your LOAN SERVICER with the best possible reasons for changing your loan, and in the strongest negotiating position.

If you do not know the answer to a question, simply put "I don't know." But it is important to both of us that you give it your best effort. Please be as complete and accurate as possible. For instance, someone who lacks a high school degree is more apt to have a claim for predatory lending than someone with a Master's Degree.

If you have already given us details about any particular question on the first form you submitted to us, it isn't necessary to repeat. Just indicate "see other form." Or you can give additional details and indicate "Also see previous form."

Our analysis of your information: We will go through your documents and interview you about potential violations of various laws. You can see our Foreclosure Worksheet to get an idea of what we examine.

Our interview with you: Once we have received and analyzed your documents and the completed form below, one of our staff will call to schedule an interview with you. We will ask you for more information about your loan transaction. You can come into our office or do the interview by phone.

A.   Questions about the Original Lender from whom you got the loan that is now a problem for you

A1.  Name of that Lender?

A2.  If the Problem Loan was a refinance, explain why you refinanced.

A3.  When you got the Problem Loan, explain how you happened to come in contact with the broker (or lender) who arranged the loan.

A4. When you took out the Problem Loan, did you do so directly with a Bank or Savings & Loan, or through a Mortgage Broker?


A5.  What did the representative tell you or NOT tell you about interest rates and payments on the Loan? Include what the representative explained about how high your interest rate and payments could go.


A6.  If your loan balance increases each month (called a "neg am" loan), what did the representative tell you or NOT tell you about that?


A7.  Did the representative tell you that he or she would receive a Yield Spread Premium? If so, what did the rep explain specifically? Most people do not know what the term "Yield Spread Premium" means.


A8.  Did you know before the loan closed that there was a prepayment penalty attached to your loan? IF so, did the loan rep tll you why it was there?


A9.  Did you have any discussions with the representative about whether you would be able to make all the Payments on the loan.


A10.  What if anything did the representative discuss with you about being able to refinance your loan? Did the representative say his or another company would arrange it at some time in the future?


B.   Questions about the Closing of your Problem Loan(s)

B1.  When you signed the final papers to get the loan, where and at what time of day did that take place? Also explain who was present when you signed, about how long the whole process took, whether you felt rushed, and whether you had questions that nobody could answer.


B2.  When you were signing the final papers to get the loan, did you see anything that looked incorrect? If so, explain what you did, if anything.


C.   Questions about the Servicers to whom you have been making make payments

C1(a), Loan 1:    Has your monthly payment increased? If so, when and what was the amount of the payment before and after the increase?


C1(b).  If not, but it WILL increase, explain when it is scheduled to go up and how much it will increase to. What is your present payment?


C1(c).  To what company do you make payments on the first loan?

D.   Questions about other payments

D1.  If you have HOA dues,how much do you pay each month?

D2.  Are you behind on property taxes? If so, how much?

D3.  Have you ever entered into an agreement with any LOAN SERVICER to make up back payments? If “yes” explain the agreement and the final outcome.


D4.  Have you used credit cards, borrowed from a retirement plan such as a 401K, taken money from savings, or borrowed from others in an attempt to keep your loan payments current? If so, give details.


Answer the next two questions if your monthly payment now INCLUDES taxes and insurance. If not, answer D5(c) instead.

D5(a).  How much are your yearly property taxes and home insurance combined? You pay property taxes twice a year, and insurance for your home once a year.


D5(b).  How much of a payment do you feel you can make each month comfortably, including property taxes and home insurance on all loans on this property?

Answer the next question only if your monthly payment does NOT INCLUDE property taxes and home insurance

D5(c).  How much of a payment do you feel you can make each month comfortably on all loans on the property? Remember that you would still have to pay your property taxes and home insurance separately each year.


E.   Questions about current contacts with the LOAN SERVICER

E1.  Phone number of Loan Servicer you have called?

Please give as much detail on this next question as possible.

E2.  Have you talked to your Loan Servicer or its attorney about your difficulty in meeting payments? If so, tell us who you talked to, when, and how the conversations went. Were the representatives rude? Were you frustrated in trying to reach anyone? Please give the names of the representatives you talked with if you remember them.


E3.  Has any Servicer made frequent phone calls to you when you stopped making payments? If so, explain how many and how often.


F.   Questions about YOU and your family

F1.  Does a Spouse or Significant Other live with you?
F2.  If you have children that you support, tell us their names, ages, and indicate which if any live with you.

F3.  If anyone else lives with you, give their names and relationship. Also give ages for anyone 65 or over.


F4.  What type of employment do you have? If you are self-employed, what is your business? Also explain how long you have been doing this type of work.


F5.  If anyone else in your residence works and contributes to the loan payments, name who and what type or employment that person has. If you get rent from someone, please give details.

F6.  If you work a second job (or lost one), what type and how much is (or was) your take home from that job?

F7.  Have you completed a bankruptcy? If so, Chapter 7 or 13? In what year did it finish?


F8.  If your problem with the Loan is because your financial situation has changed, please explain. For example: loss or change of job, reduction in income, illness, emergency/disaster (flood, fire), divorce, care of your parents, child care/education, or any other situation.


F9.  Do you have any other financial commitments over $10,000, e.g., student loan, mortgage on rental property? If so, please describe


F10.  Is anyone else contributing to the house payment? If "yes," please describe who and how much. What is the source of the contributor's income, and will it continue for the foreseeable future?


F11.  What is your highest level of education?

F12.  What the highest level of education of any other person who contributes to the house payment?

G.   Questions if you are now in foreclosure

G1.  If you are now in foreclosure, when did it begin? That will be the date on the Notice Of DEFAULT. Please confirm.


G2.  If you have received a Notice of SALE, when did you receive it, and what is the date of the scheduled sale of the property exactly? (VERY IMPORTANT)


H.   Questions if your property is a rental

H1.  What is the status of your rental?

H2.  How long has your tenant been renting from you

H3.  How much rent does the tenant pay monthly?
